When seeking to hire foreign nationals, you must illustrate that there are currently no American workers who are qualified, willing and able to fill the available position. In order to do this, you need to file a Labor Condition Application with the Department of Labor. This filing must specify various facts about the position such as the job description, salary, length of employment and the geographic location of the position.

PERM

The labor certification process could take two to three months and is tracked through the DOL’s online system called PERM. This system is used to track and accept labor certification applications. If the DOL accepts the application and issues a labor certification notice, you are free to hire a foreign worker for the position.

We understand that this process doesn’t always go well or without issue. Thus, we are here to help you navigate any obstacles or pitfalls you may encounter. Whether you are a small or large company, you could benefit from having a legal team by your side when handling labor certification matters.
